Definitions

Member: Any individual who is registered with Best Kept Shared as a Renter, Lender, Reseller or Purchaser.
Renter: Any individual who is registered with Best Kept Shared and has/ is undertaking Rental or Purchase activities for other members wardrobe items.
Lender: Any individual who is registered with Best Kept Shared and has/ is undertaking Lending or Resale activity of their own wardrobe items.
Terms: Means these Terms of service and our privacy policy
Rent/ Rental/ Renting: To Rent a Lenders item for a Rental fee through the Best Kept Shared platform, in compliance with the Renter and general Terms.
Lend/Lending: To Lend a Lenders item to a Renter for a Rental fee through the Best Kept Shared platform,in compliance with the Lender and general Terms.
Resale/ Sell: To sell a preloved Members item to any Member or Non Member for a Rental fee through the Best Kept Shared platform, in compliance with the Resale and general Terms.
Purchase/ Buy: For any Member or Non Member to Purchase a preloved Members item for a Rental fee through the Best Kept Shared platform, in compliance with the Resale and general Terms.

1.0 Best Kept Shared

1.1 Who we are: We are the region’s first peer to peer fashion rental & resale platform. The AirBnb of luxury fashion, if you will. Our service connects progressive women who are interested in circular fashion and allows members to lend and rent clothes and accessories. Best Kept Shared is the provider of the platform and the organiser of logistics and acts only as intermediary between the Renter and Lender.

1.2 Company formation: Best Kept Shared is owned and operated by Best Kept Shared FZCO, a UAE based company that is incorporated in compliance with the rules and regulations of International Free Zone Authority (IFZA). Our registered business address is Dubai Silicon Oasis, DDP, Building A2, Dubai, United Arab Emirates and trade license number is 9543. We are contactable in writing at PO Box 454430 or [email protected] or via phone at 055 570 1717.

1.3 Membership: To use Best Kept Shared you must be a Member of the platform. In becoming a Member you accept that you are bound by our Terms of service.

1.3.1 Individuals can become Members if they are over 18 years of age and are UAE residents with a valid Emirates ID. You will need to successfully complete our third party ID verification process via our 3rd party provider Yoti, before being accepted onto the platform. We are under no obligation to accept individuals onto the platform. We do not store your Identification Card Information.

1.3.2 Businesses can become members if they meet the brand alignment requirements of Best Kept Shared. We are under no obligation to accept business members onto the platform.

1.3.3 Revoking of membership: You understand that Best Kept Shared has the right to revoke your membership and remove you from the community with immediate effect if these Terms of service are breached or if you commit offenses such as, but not limited to; repeatedly damaging items, not returning items on time, canceling requests, listing unauthentic items or items that do not meet our criteria, uploading fraudulent ID documentation or impersonating someone else, theft, uploading content or data you do not have the rights to and anything else we deem as an offense that could threaten the integrity of the site. In addition any appropriate action will be taken with the local authorities if deemed necessary.

1.4 Terms of Service: We reserve the right to make amendments or additions to our Terms of Service in the future, any changes will be posted on this page. Please check back to stay up-to-date and see any updates or changes to our Terms of Service.

2.0 Rental Terms

2.1 Availability: All items on the platform are subject to availability and your ability to rent them is subject to approval by the Lender. The Lender is under no obligation to accept rental bookings and is in complete control of the item calendar, item price and optional security deposit.

2.2 Rental Durations: We currently offer two rental durations:

  • The One-Night Stand - 3 day rental
  • The Staycay - 1 week rental

We also offer a resale option (clause 7) where the individual can purchase the item if it is listed for sale.

2.3 Fit Guarantee: We offer a 100% fit guarantee. If your item does not fit then you will not be charged for the rental. To do so, you cancel the rental request immediately through the Renting tab quoting "item does not fit" as the reason. You will only be charged only the delivery fee. You have up to 4 hours to complete this action, after which you will need to contact us directly.

2.4 Refund for rental: Your item will arrive on the first day of your booking. In the unfortunate event that the item is not delivered by the requested delivery date, the item that is delivered is not as described or shown on the site or is not in acceptable condition, the Renter will be entitled to a full refund of Rental Price and delivery charges. You can request a refund on your RENTING TAB > SELECT BOOKING >RETURN within 4 hours of receiving the item.

2.4.1 Reasons for return include:

  • Item is in poor condition/damaged
  • Item looks different to image/description on site
  • Incorrect item received
  • Item didn’t arrive in time

2.4.2 Refund process:

Refunds will be made back to the payment solution used initially by the customer. Except for cash payments which will be refunded in BKS Credit. Please allow for up to 45 days for the refund transfer to be completed.

2.5 Pricing: Best Kept Shared acts as a marketplace and makes pricing recommendations to the Lenders on the platform. However, the Lender has the ability to override the price and list the item at the market value they feel most appropriate.

2.5.1 Commision: Best Kept Shared takes a 15% fee from the Renter and a 15% fee from the Lender for rental transactions. Dry cleaning is paid for by the Renter and delivery is paid for by the Lender.

2.5.2 Best Kept Shared reserves the right to make amendments to it’s fee structure in the future.

2.5.3.1 Payment is taken via our secure payment platform, Telr and Best Kept Shared does not store any of your payment data directly.

2.5.3.2 Payment confirmation will be shared with the customer via email.

2.4.3.3 We accept payment in AED only and accept payment from Visa and Mastercard.

2.4.3.4 Cardholder must retain a copy of transaction records and Merchant policies and rules.

2.4.3.5 The Member is responsible for maintaining the confidentiality of their account and not share their log in or password with anyone.

2.6 Rent to buy: For items that are listed for both rent and resale, we will soon offer a Rent-to-Buy option that allows the Renter to keep the item after they have rented it by just paying the difference between the rental price and the sale price. This offer must be availed before the item is returned to the Lender. Once the item has been returned to the Lender the Renter will have to pay the full price listed for purchase should they wish to buy then buy the item. The rent to buy option is only available on items for which the Lender has opted to sell the item as outlined in resale Clause 7.

2.7 Renter Cancellation: The Renter can cancel the rental at no charge up to one week ahead of the rental date. If a cancellation is made within one week of the rental date the Renter will be changed 20% of the rental free. If the cancellation is made within 48 hours of the booking date that fee will increase to 50% of the rental price. If you are constantly booking and cancelling items Best Kept Shared reserves the right to revoke your membership.

2.8 Late return penalty fees: You will be charged a late fee of 150 AED per day for late returns past the Rental return date unless negotiated and approved directly with the Lender.

2.9 Rental Agreement: When renting an item from a Lender you understand that you are entering into an agreement directly with the Lender and you understand that the Lender is not acting on behalf of Best Kept Shared but is rather providing a service directly to you for the rental of their item. Best Kept Shared will not be liable for any loss or liability suffered by you a Renter by acts or omissions of the Lender.

2.9.1 You accept that you are exclusively responsible for the item that you are renting and you are responsible for any compensation that is required for damage or loss of the item as detailed in Clause 2.10.

2.9.2 You understand that as a Renter or Lender, should you be caught acting fraudulently in any way that Best Kept Shared reserves the right to revoke your membership immediately.

2.9.3 You agree to comply with the Laws and Jurisdiction of the United Arab Emirates, our country of domicile, when transacting on the platform and understand that should you be caught breaking the law, Best Kept Shared reserves the right to take the relevant legal action against you.

2.10 Damage of rental items

2.10.1 You understand and agree that for Rental items that request a security deposit, the amount of the Security Deposit will be held on your (The Renter) credit card for the duration of the rental agreement (3 days or 1 week). If the item is returned in the same condition as it was before the rental took place, the security deposit will be released back to you. In cases of dispute of the condition of the returned item, you, the Renter, will be charged in part or in full for the value of the security deposit or will owe the Lender the exceeding damage cost, whichever is greater.

2.10.2 You, the Renter, Acknowledge and agree that if there is damage to an item you have rented during the period of that rental that can not be repaired via the means of Dry cleaning or Tailoring that you will be liable for the full repair cost of the item or to pay the full security deposit (if applicable), whichever is greater.

2.10.3 You, the Renter, Acknowledge and agree that if an item is damaged beyond repair during the period of the rental you will be liable to pay the lender the full security deposit (if applicable) or the cost of the current market value of the item, whichever is greater.

3.0 Lender Terms

3.1 Listing criteria Items listed on the site must meet the following criteria.

We accept clothing, bags, shoes and accessories from high-end Cult, Contemporary & Luxury women's wear fashion brands or vintage items.

All items must be authentic and in pristine condition. Spot checks will be carried out and authenticity proof will be required.

We do not accept fast fashion brands.

All items must have a minimum RRP of AED 500.

We are under no obligation to accept items onto the platform.

3.2 Wardrobe Storage

3.2.1 If you choose our traditional peer-to-peer lending model then you agree to:

Store, maintain and manage your own wardrobe items

Ensure items have been dry cleaned ahead of each rental

Manage all rental requests within 12 hours of receiving them

Maintain your wardrobe calendar and ensure that it is always up to date and unavailable dates are blocked out

3.2.2 For Managed Wardrobe service, Best Kept Shared will store your items in-house and manage the rental requests & logistics for you.

In accepting these Terms of service, all Lenders confirm that all listed items are authentic and in pristine condition. Best Kept Shared does not take responsibility for the condition of the items from either peer to peer or managed wardrobe items, these are the responsibility of the Lender.

3.3 Lender Cancellation: If a Lender cancels within the late cancellation period of 1 weeks ahead of Rental date; they will be given a penalty strike, if they receive 3 strikes then their account will be deactivated. If the Lender cancels the booking within one week of the rental date they will also receive a 150 AED penalty. As a lender you can cancel a request from your order management details page in the dashboard. You will be asked to fill in a short cancellation form with one of the following reasons for cancellation: - Last minute travel - Lender no longer interested in renting this item - Item is sold.

3.4 Lender Payment: Once the successful rental transaction has been completed and returned to the Lender (with no request for cancellation or refund within the 4 hour cancellation period, after time of delivery), you will receive Best Kept Shared credit in to your Best Kept Shared Wallet for the amount of the Rental Fee minus the Best Kept Shared Commision (30% for Rental and 35% for Resale), the delivery amount (25 AED) and the dry cleaning fee that the renter paid (where applicable). For our managed wardrobe service we work on a profit share basis and split the net revenue fifty:fifty (50/50), of the rental or resale amount, minus delivery amount.

3.4.1 You can then request to transfer the credit to your bank account or use it as credit on the site for your next rental.

3.4.2 Please allow between 10-14 working days for the transferred money to reach your bank account depending on your bank's processing time.

3.4.3 The processing fee for sending the money to your bank account is AED 1.

3.4.4 We only transfer money to UAE banks and in AED currency.

4.0 Delivery

4.1 Delivery is provided via our courier service - Yango. The item will be collected from the Lender and sent to the Renter on the first day of the Rental Duration or the purchase for Resale items.

4.1.2 The delivery charge (25AED one way/ 35AED Return) is included in the rental fee for all successful rentals.

4.1.3 The delivery charge (25AED one way) is included in the purchase price for our Resale items.

4.1.4 Best Kept Shared manages the pick up and delivery of the items through our 3rd party supplier - Yango. The following information will be shared with the vendor in order for them to complete the service: (Lender & Renter) Name, Telephone number, Address, Item information (Brand, Value, Category), Collection and drop off time and date.

4.1.5 The courier will register proof of delivery confirmation.

5.0 Dry Cleaning

5.1 Dry cleaning is mandatory for all rentals and will be arranged by Best Kept Shared via our 3rd party dry cleaning supplier - Champion Cleaners. The dry cleaners will collect the item from the Renter and return it, cleaned, to the Lender. The following information will be shared with the vendor in order for them to complete the service: (Lender & Renter) Name, Telephone number, Address, Item information (Brand, Value, Category), Collection and drop off time and date.

5.1.2 For first time rentals it is the responsibility of the Lender to ensure that the item is dry cleaned and ready for rental.

6.0 Payment

6.1 We currently accept the following tender types for Orders placed on our Website: Visa, Mastercard or Cash on Delivery and online credit. Payment will be taken at the time you place your Order for purchases and at the time of rental request approval for rentals.

6.1.1 Payment confirmation will be shared with the customer via email.

6.1.2 We accept payment in AED only and accept payment from Visa and Mastercard.

6.1.3 Cardholder must retain a copy of transaction records and Merchant policies and rules.

6.1.4 The Member is responsible for maintaining the confidentiality of their account and not share their log in or password with anyone.

6.1.2 By entering payment details onto our Website, you warrant that you are duly authorized to pay using those details. We reserve the right to decline orders without liability to you where we believe payments are not authorized, the payment method is not valid or where we do not think you are authorized to use to utilize the relevant tender type.

6.2.3 You understand and agree that for Rental items that request a security deposit, the amount of the Security Deposit will be held on your (The Renter) credit card for the duration of the rental agreement (3 days or 1 week). If the item is returned in the same condition as it was before the rental took place, the security deposit will be released back to you. In cases of dispute of the condition of the returned item, you, the Renter, will be charged in part or in full for the value of the security deposit or will owe the Lender the exceeding damage cost, whichever is greater.

6.2.4 You, the Renter, Acknowledge and agree that if there is damage to an item you have rented during the period of that rental that can not be repaired via the means of Dry cleaning or Tailoring that you will be liable for the full repair cost of the item or to pay the full security deposit (if applicable), whichever is greater.

6.2.5 You, the Renter, Acknowledge and agree that if an item is damaged beyond repair during the period of the rental you will be liable to pay the lender the full security deposit (if applicable) or the cost of the current market value of the item, whichever is greater.

7.0 Resale Terms

7.1 Pricing: Best Kept Shared acts as a marketplace and makes pricing recommendations to the Lender/s on the platform. However, the Lender has the ability to override the price and list the item at the market value they feel most appropriate.

7.1.1 Best Kept Shared takes a 35% fee from the Lenders resale transaction earnings on our standard peer to peer model. Best Kept Shared takes a 50% fee for resale transactions with Lenders who are availing our Managed Wardrobe Service. Delivery is paid for by the Lender.

7.1.2 Best Kept Shared reserves the right to make amendments to it’s fee structure in the future.

7.1.3 Payment is taken via our secure payment platform, Telr and Best Kept Shared does not store any of your payment data directly.

7.2 Condition: Items listed for resale may vary in condition, although all items listed for resale must still be in good usable condition with minimal signs of wear, and it is the responsibility of the Lender to declare the condition of the item as per the following categories: New with tags, Like New, Gently Used, Used, Well Used.

7.3 In accepting these Terms of service, all Lenders confirm that all listed items are authentic and in pristine condition. Best Kept Shared does not take responsibility for the condition of the items, these are the responsibility of the Lender.

7.4 Refund for resale:

You can request a full refund within three days of receiving the item via RENTING TAB > SELECT BOOKING >RETURN

7.4.1 Reasons for return include:

Item is in poor condition/damaged

Item looks different to image/description on site

Incorrect item received

Item didn’t arrive in time

7.4.2 Return payment process:

Refunds will be made back to the payment solution used initially by the customer. Except for cash payments which will be refunded in BKS Credit. Please allow for 10-12 days for the refund transfer to be completed.

8.0 Off-site transactions

Best Kept Shared provides the safest way to rent your wardrobe. We ensure the security of our platform and community through ID verification, peer to peer reviews, secure messaging & payment and an open portal. If you are caught transacting with another member offsite you will be immediately banned from using the site, as will the other corresponding Member.

8.0 Intellectual Property & Confidentiality: All materials on this site are protected by copyright and all rights are reserved. We are the owner of all intellectual property on this website including logos, icons, text, images, videos, graphics, page layout, code and software.

8.1 You acknowledge that all content on Best Kept Shared will be accessible to others and you waive any rights to confidentiality or rights to the uploaded content.

8.2 Content upload. It is the responsibility of the Member to photograph the items for listing uploads. You agree to only upload accurate, true and unenhanced photographic content of the items to Best kept Shared and confirm that you hold the applicable rights. We suggest photographing the item on a hanger or mannequin with a plain white background and be sure to shoot from multiple angles and capture the item details. Best Kept Shared reserves the right to remove or edit any photographs we consider to be inappropriate, tampered with or inaccurately displaying the item.

8.3 Street style content: Best Kept Shared boasts IRL & Social feeds, Style boards and Lender & Designer spotlights where Members upload street style pictures of themselves. You retain intellectual property rights to your own content but in uploading street style content to the site or by tagging us through @ or #’s on our social media you grant Best Kept Shared a royalty free and irrevocable sub-licence to reuse the content for any purposes we see fit.

8.4 You acknowledge and accept that Best Kept Shared will not continuously monitor item, content and data uploads but should we find any items, content or data that does not comply with these Terms of service we reserve the right to update, edit, approve, reject or remove the content, item listing, data and/or listing criteria at any time without cause and at our sole discretion.

9.0 Indemnification

You agree to hold harmless Best Kept Shared and all our affiliates (including shareholder, founders, team members, members and suppliers) to the fullest extent lawful, against any and all losses, damages, liabilities, costs, and expenses, joint or several, to which the Indemnified Parties may become subject.

10.0 Governing law

You agree that any claim relating to the access or use of our Services shall be governed by the laws and Jurisdiction of the United Arab Emirates, our country of domicile.

11.0 Trade

We will not trade with or provide any services to OFAC and sanctioned countries.

12.0 Privacy

Through accepting a membership with Best Kept Shared you give consent for us to collect, transfer, store and use your personal information.

13.0 Communication

Through accepting a membership with Best Kept Shared you give consent to communicate with you via phone, email and on the Best Kept Shared platform.
